Plick Beta Terms of Use

Welcome to Plick ("Plick," "we," "our," or "us").

Thank you for participating in the Plick Beta Program (the "Beta" or "Service"). These Terms of Use ("Terms") govern your access to and use of our website, application, and related services that are currently in beta testing.

PLEASE READ THESE TERMS CAREFULLY.

By accessing or using the Beta Service, you agree to these Terms and our Privacy Policy (collectively, the "Agreement").


If you do not agree, do not use the Beta Service.

1. Beta Service Description

Plick provides an AI-powered platform that helps users generate and manage social media content ideas and posts.
The Beta Service is a pre-release version made available for testing, feedback, and evaluation purposes only. It may contain bugs, errors, or other issues that could affect operation or performance. The Beta is provided "as is" and "as available."

We may add, modify, or remove features at any time without notice. We make no guarantees that any features of the Beta will ever become part of the final released product.


2. Eligibility and Account

To participate in the Beta, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction);
  • Provide accurate and complete registration information; and
  • Maintain the confidentiality of your account credentials.

We reserve the right to suspend or terminate Beta access for any reason, without notice or liability.


3. License and Restrictions

3.1 Limited License.

During the Beta, Plick grants you a non-exclusive, revocable, non-transferable license to access and use the Beta Service solely for evaluation purposes.

3.2 Restrictions.

You agree not to:

  • Use the Beta for commercial production purposes;
  • Copy, modify, reverse engineer, or distribute any part of the Service;
  • Interfere with its operation or attempt to gain unauthorized access;
  • Use it for unlawful or harmful activities.

3.3 Feedback.

You may submit ideas, suggestions, comments, or reports ("Feedback") about the Beta.
You grant Plick a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate Feedback for any purpose, without obligation or attribution.


4. Beta Disclaimer

You understand and agree that:

  • The Beta may be incomplete, unstable, or inaccurate.
  • Features and data may change, be lost, or become unavailable at any time.
  • The Beta may be discontinued temporarily or permanently without notice.

You assume all risk arising from using the Beta. Plick disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

5. AI-Generated Content Disclaimer

Plick uses artificial intelligence and automated systems to generate text, images, and other content (collectively, "AI-Generated Content").

You understand and agree that:

  1. AI Output Nature: AI-Generated Content is created automatically based on patterns in data and may include inaccuracies, unintended biases, or content that some users may find offensive, inappropriate, or otherwise objectionable, even though this is not the intention of Plick.
  2. User Responsibility: You are solely responsible for reviewing, evaluating, and using any AI-Generated Content before publishing, relying upon, or distributing it.
  3. If Offended or Concerned: If you encounter AI-Generated Content that you find offensive, harmful, or otherwise undesirable, you should immediately delete such content and stop using the Service.
  4. No Warranty. Plick makes no representations or warranties regarding the accuracy, reliability, or suitability of any AI-Generated Content.
  5. Assumption of Risk: By using the Service, you acknowledge and accept that you may receive or generate such content as described above and that Plick is not liable for any resulting damages, offense, or harm.

6. User Content

If you upload, submit, or generate content ("User Content") through the Beta:

  • You retain ownership of your User Content.
  • You grant Plick a limited license to host, process, and display your User Content to operate and improve the Beta.
  • You represent that you have all rights necessary for such use and that your content does not violate any law or third-party rights.

We may remove or delete User Content at any time as part of the Beta process.


7. No Support

Except for otherwise provided separately to you, all support is provided at Plick's discretion and will be subject to Plick's published policies.


8. International Use

The Service is intended for users located within the United States. We make no representation that the Service is appropriate or available for use outside of the United States. Access to the Service from countries or territories or by individuals where such access is illegal is prohibited.


9. Confidentiality

The Beta, including its features, documentation, and performance information, is confidential.

You agree not to disclose or share details of the Beta Service, user interface, or performance publicly without Plick's written consent.

This does not apply to information that is or becomes publicly known through no fault of yours.


10. Termination

We may terminate or suspend your Beta participation at any time, without notice.
Upon termination:

  • You must stop using the Beta immediately;
  • Your account and data may be deleted; and
  • Certain sections (Feedback, Disclaimers, Liability, Confidentiality) will survive termination.

11. Indemnity

You agree to defend and hold harmless Plick and its affiliates, officers, and employees from any claims or damages arising from:

  • Your use of the Beta;
  • Your breach of these Terms; or
  • Your User Content.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Plick will not be liable for any indirect, incidental, special, consequential, or punitive damages, including data loss, downtime, or loss of profits.
  • Our total cumulative liability will not exceed $50 USD, even if we have been advised of possible damages.

These limitations apply even if a remedy fails for its essential purpose.


13. Changes to the Beta or Terms

We may update or modify these Terms at any time by posting the updated version on our site or notifying you via email.

Your continued use of the Beta after changes take effect means you accept the revised Terms.

We may also stop offering the Beta at any time without notice.


14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
Any dispute arising from these Terms or the Beta will be resolved exclusively in the state or federal courts located in Santa Clara, CA, and you consent to personal jurisdiction there.


15. Miscellaneous

  • These Terms constitute the entire agreement between you and Plick regarding the Beta.
  • If any provision is found invalid, the rest will remain in effect.
  • You may not assign these Terms; we may assign them without notice.
  • Failure to enforce any right does not waive it.
